Assistant General Counsel Records Access Officer Massachusetts Bay Transportation Authority 10 Park Plaza Suite 3910 Boston, MA 02116 Dear Attorney Ciollo: I have received the petition of Andrea Estes appealing the response of the Massachusetts Bay Transportation Authority (MBTA) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 13, 2023, Ms. Estes requested the following records: 1. all emails, including attachments to those emails, between [named persons] between March 1, 2020 and June 9, 2020. 2. all emails, including attachments to those emails, between [named persons] between November 1, 2019 and March 31, 2020[.] On March 27, 2023 and April 5, 2023, Ms. Estes modified her request for only the emails between named individuals for the period of March 1, 2020 to June 9, 2020. The MBTA responded on March 27, 2023; March 28, 2023 and April 5, 2023. Unsatisfied with the MBTA’s responses, Ms. Estes petitioned this office and this appeal, SPR23/0817, was opened as a result. Subsequently, I learned that the MBTA provided a further response to Ms. Estes on April 27, 2023. Where the basis of this appeal was opened as a result of the MBTA’s March 27th, March 28th and April 5th responses, I will now consider this administrative appeal closed. Ms. Estes may appeal the substantive nature of the MBTA’s April 27th response within ninety (90) days. See 950 C.M.R. 32.08(1).
