See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 11, 2023, Mr. DeMeo requested “... all emails between [named employee] and planning board members from March 1, 2023 till April 11, 2023 [and] all e-mails between [named employees] between January 1, 2023 and April 11, 2023.” Claiming to not yet have received responsive records, Mr. DeMeo petitioned this office and this appeal, SPR23/0827, was opened as a result. Subsequently, I learned that the City provided Mr. DeMeo with a response dated May 4, 2023. Where the basis of this appeal was opened as a result of the City’s lack of a written response, I will now consider this administrative appeal closed. Mr. DeMeo may appeal the substantive nature of the City’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
