The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records May 16, 2023 SPR23/0862 Anne Drouin Super RAO Clerk Department City of Methuen 41 Pleasant Street Methuen, MA 01844 Dear Ms. Drouin: I have received the petition of Abel Cano Jr. appealing the response of the City of Methuen (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 29, 2023, Mr. Cano requested a list of persons granted the rank of Sergeant in the Methuen police department from January 2000 to March 2023. On April 12, 2023, the City responded with responsive records. Unsatisfied with the City’s response, Mr. Cano petitioned this office and this appeal, SPR23/0862, was opened as a result. Based upon a conversation between a Public Records Division staff attorney and a City representative, it is my understanding that the City intends on providing a subsequent response to Mr. Cano. Accordingly, the City is ordered to provide Mr. Cano with said response, in a manner consistent with the Public Records Law and its Regulations within 10 business days. A copy of the response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Cano may appeal the substantive nature of the City’s response within ninety days. See 950 C.M.R. 32.08(1).
