Counsel to the Commissioner Litigation Bureau Department of Revenue 100 Cambridge Street, 7th Floor Boston, MA 02114-9565 Dear Attorney Randall: I have received the petition of Allyson M. Presskreischer, Esq., of Barrault & Associates, LLC, appealing the response of the Department of Revenue (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 11, 2023, Attorney Presskreischer requested the following records: 1. Copies of all documents, files, reports, and any other information provided to the Department by the City of Lynn in connection with their ‘Financial Analysis/City of Lynn’ dated January 2023. 2. All letters, emails, notes, work papers, report preparation plans and programs, progress reports, and any and all other documents generated by or received by DOR in connection with the January 2023 ‘Financial Analysis / City of Lynn.’ 3. Copies of all documents, files, and reports submitted to or received from the City of Lynn pursuant to Chapter 58 of the Massachusetts Acts of 2018 ... from 12/20/2020 to the present. 4. Listing of the names and titles of all DOR employees involved in preparation and issuance of the January 2023 ‘Financial Analysis /City of Lynn.’ 5. A listing of all meetings and calls, including date, time, and names of all participants, held with the City of Lynn in connection with the January 2023 ‘Financial Analysis /City of Lynn’ or in connection with Chapter 58 of the Massachusetts Acts of 2018 since January 1, 2022. 6. A listing of all calls, meetings or other communications to, from, or with City of Lynn Labor Counsel ... or to, from, or with Lynn Mayor ... [from] ... July 1, 2021 to the present. The Department responded on April 11, 2023; April 19, 2023 and April 20, 2023. Unsatisfied with the responses, Attorney Presskreischer petitioned this office and this appeal, SPR23/0863, was opened as a result. SPR23/0863 Page 2 May 16, 2023 Based upon a conversation between an attorney of the Public Records Division and a Department representative, it is my understanding that the Department intends on providing a further response to Attorney Presskreischer. Accordingly, the Department is ordered to provide Attorney Presskreischer with said response in a manner consistent with the Public Records Law and its Regulations within 10 business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us.
