G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 18, 2023, Mr. Sciacca requested “the report commissioned by the mayor/city by Comprehensive Investigation and Consulting regarding past and present Malden fire department personnel and practices including but not limited to the conduct of [a specific] former firefighter.” The City responded by denying the request and stating that “the information requested is confidential.” Unsatisfied with the City’s response, Mr. Sciacca appealed, and this case was opened as a result. Based on a telephone conversation between this office and the City on May 9, 2023, I understand that the City intends to provide a supplemental response to Mr. Sciacca. Accordingly, said response must be provided to Mr. Sciacca in a manner consistent with the Public Records Law and its regulations within ten business days. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. If issues remain unresolved, Mr. Sciacca may appeal the substantive nature of the City’s supplemental response within ninety days. See 950 C.M.R. 32.08(1).
