Silvia Director of Communications Department of Correction 50 Maple Street Milford, MA 01757 Dear Ms. Silvia: I have received the petition of Edward Gajka appealing the nonresponse of the Department of Corrections (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 27, 2023, Mr. Gajka requested “[a] copy of all substitutes on the dialysis meals from 02/10/23 to 03/27 /23 [and] ... the dates and time of the approved items. Also want copies of sign[ed] paperwork that ok such changes. And also want the approved departmental substitution guidelines for dialysis meal.” Claiming to not yet have received responsive records, Mr. Gajka petitioned this office and this appeal, SPR23/0875, was opened as a result. Subsequently, I learned that the Department provided Mr. Gajka with a response dated April 5, 2023. Where the basis of this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Mr. Gajka may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
