Silvia Director of Communications Department of Correction 50 Maple Street Milford, MA 01757 Dear Ms. Silvia: I have received the petition of Edward Gajka appealing the nonresponse of the Department of Corrections (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 27, 2023, Mr. Gajka requested “[a] copy of all substitute on the dialysis meals from 02/10/23 to 03/27 /23 [and] ... the dates and time of the approved items. That was send to [a named individual]. And also want the approved departmental substitution guidelines for dialysis menu.” Claiming to not yet have received responsive records, Mr. Gajka petitioned this office and this appeal, SPR23/0876, was opened as a result. Subsequently, I learned that the Department provided Mr. Gajka with a response dated April 5, 2023. Where the basis of this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Mr. Gajka may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
