See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 12, 2023, Mr. O’Toole requested the following records: [1.] All documentation, correspondences, photos and reports concerning HVAC insulation mockups pursuant to section 23 07 00 of HVAC Insulation Specification- Quality Assurance 1.05.C.1-1.05.C.2 (Noted Below) and Consigli’s Construction QA/QC program. [2.] All documentation, correspondences, photos and reports concerning HVAC Insulation progress and QC. [3.] All documentation, correspondences, photos and reports concerning Plumbing Insulation progress and QC. Claiming to not yet have received responsive records, Mr. O’Toole petitioned this office and this appeal, SPR23/0929, was opened as a result. Subsequently, I learned that the City provided Mr. O’Toole with a response dated May 8, 2023. Where the basis of this appeal was opened as a result of the City’s lack of a written response, I will now consider this administrative appeal closed. Mr. O’Toole may appeal the substantive nature of the City’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
