The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records May 24, 2023 SPR23/0949 Joseph Vizard City Clerk City of Waltham 610 Main Street Waltham, MA 02452 Dear Mr. Vizard: I have received the petition of Matthew Lyons appealing the response of the City of Waltham (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 31, 2023, Mr. Lyons requested an “[o]rdinance or other signed official City of Waltham documentation supporting the water departments billing select larger condos including, but not limited to, [named properties] and more a fixed ‘Tier 2 only’ water & sewer rate, contradicting the city engineer published signed rate table.” On May 2, 2023, the City responded providing responsive records. Unsatisfied with the City’s response Mr. Lyons, petitioned this office and this appeal, SPR23/0949, was opened as a result. Based upon a conversation between a Public Records Division staff attorney and a City representative, it is my understanding that the City intends on providing a subsequent response to Mr. Lyons. Accordingly, the City is ordered to provide Mr. Lyons with a response to his request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. A copy of the response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Lyons may appeal the substantive nature of the City’s response within ninety days. See 950 C.M.R. 32.08(1).
