Town Counsel Murphy, Hesse, Toomey & Lehane, LLP 300 Crown Colony Drive, Suite 410 Quincy, MA 02169 Dear Attorney Cavanaugh: On May 10, 2023, this office received your petition on behalf of the Town of Dracut (Town) seeking an extension of time to produce records and permission to charge for time spent segregating or redacting responsive records. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv). As required by law, it is my understanding that the Town furnished a copy of this petition to the requestor. Id. On April 30, 2023, Richard J. Silvio requested “any emails containing, [a named individual], ‘Council on Aging’, ‘Dracut Senior Center’, [a named individual] written between 3/1/23 to 4/30/23.” Subsequent to the opening of this petition, I learned that Mr. Silvio modified his request. In an email to the Town dated May 11, 2023, Mr. Silvio states, “[g]iven the large fee attached, I would like to revise my… request to any emails containing [a named individual] dated 3/10/23 to 4/20/23.” Conclusion In light of the above, it is unnecessary to opine on the Town’s petition for an extension of time to produce records and permission to charge for time spent segregating or redacting responsive records. It is my understanding that on May 12, 2023, the Town submitted another time and fee petition that is currently open as SPR23/0995. This office encourages Mr. Silvio and the Town to continue to communicate to facilitate providing records more efficiently and affordably. See G. L. c. 66, § 10(b)(vii).
