The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records May 24, 2023 SPR23/1022 Sigalle Reiss Director of Public Health and Human Services Town of Brookline Public Health Department 11 Pierce Street Brookline, MA 02445 Dear Ms. Reiss: I have received the petition of Leonard Bernstein appealing the nonresponse of the Town of Brookline Public Health Department (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 6, 2023, Dr. Bernstein requested “copies of public records of the Brookline Health Department of all Order Letters, warning letters, fines levied, emails, logs of telephone calls or personal communications or any other communications to any person(s) associated with the managing board or any member of that board of the Peabody Terrace Condominium Association (PTCA) or any management company for PTCA, specifically any person or persons of The Albert Corporation and any similar communications or phone calls or logs of personal communications to or with any other Town of Brookline official in reference to PTCA for the period of March 1, 2022 to March 31, 2023.” Claiming to not yet have received a response, Dr. Bernstein petitioned this office and this appeal, SPR23/1022, was opened as a result. Subsequently, I learned that a representative from the Department intends on providing a written response to Dr. Bernstein. Accordingly, the Department is ordered to provide Dr. Bernstein with a response in accordance with the Public Records Law, its Regulations and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Dr. Bernstein may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1).
