Counsel to the Commissioner Litigation Bureau Massachusetts Department of Revenue 100 Cambridge Street, 7th Floor Boston, MA 02114-9565 Dear Attorney Randall: I have received the petition of David McKenna, of Greater Boston Legal Services appealing the nonresponse of the Department of Revenue (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 12, 2023, Mr. Mc,Kenna requested the following records: [1.] What total number of self-employed people have opted in to PFML? [2.] What number of self-employed people paid PFML contributions for each quarter in 2022? Claiming to not yet have received responsive records, Mr. McKenna petitioned this office and this appeal, SPR23/1037, was opened as a result. Subsequently, I learned that the Department provided Mr. McKenna with a response dated May 17, 2023. Where the basis of this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Mr. McKenna may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
