G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 11, 2023, Mr. DeMeo requested “…copies of all correspondence… relative to [the City’s] proposal to rezone land to commercial on Route 140” as well as the names of companies that “…have expressed a desire to build in Gardner.” Previous appeal This request was the subject of a previous appeal. See SPR23/0869 Determination of the Supervisor of Records (May 3, 2023). The City provided a response on May 2, 2023. Unsatisfied with the response, Mr. DeMeo petitioned this office and this appeal, SPR23/1050, was opened as a result. Subsequently, I learned that the City provided Mr. DeMeo with a further response dated May 3, 2023, in which the City provided a PDF of the requested records. Where this appeal was opened as a result of the City’s May 2, 2023 response, I will now consider this administrative appeal closed. Mr. DeMeo may appeal the substantive nature of the City’s May 3rd response within ninety (90) days. See 950 C.M.R. 32.08(1).
