See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 27, 2023, Mr. Nutting requested the following records: 1) All documents relating to the current DCF open case with the Nutting Family. 2) All documents, phone logs, text messages, handwritten notes, emails, mtg minutes, video graphic and photographic materials, audio recordings, voicemails, call logs etc related to this case or containing the[identified] names, voices or images of ... 3) Any and all information of the type listed above from the initial filing with DCF from the Stow Police Department or the MA District or Family Courts. 4) Any and all information of the type listed above from the Investigatory Stage of this DCF filing, conducted by Ms... or any other persons related to or involved in this case investigation. Claiming to not yet have received responsive records, Mr. Nutting petitioned this office and this appeal, SPR23/1093, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Department has provided a response. Accordingly, the Department is ordered to provide Mr. Nutting with a response to her request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Nutting may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
