Associate General Counsel Cannabis Control Commission Union Station, Second Floor 2 Washington Square Worcester, MA 01604 Dear Attorney Carter: I have received the petition of Quinn Heath appealing the nonresponse of the Cannabis Control Commission (Commission) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 18, 2023, Quinn Heath requested “[a]ll deliveries provided by Ernst & Young LLP to the Cannabis Control Commission Contract Bid No. #BD-21-2018-CNB- CNB3-58097. ‘All deliveries’ shall include but not be limited to the following documents described [in] the attached Ernst & Young LLP bid proposal and CCC Requests for Quotes (1) results of the ‘Classification Review’; (2) results of the ‘Compensation Design’ study; (3) results of the Salary Pay Equity study; (4) any final report prepared by Ernst & Young for the Cannabis Control Commission.” Claiming to not yet have received responsive records, Quinn Heath petitioned this office and this appeal, SPR23/1097, was opened as a result. Subsequently, I learned that the Commission intends on providing a written response to Quinn Heath. Accordingly, the Commission is ordered to provide Quinn Heath with said response in accordance with the Public Records Law, its Regulations and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Quinn Heath may appeal the substantive nature of the Commission’s response within ninety days. See 950 C.M.R. 32.08(1).
