Assistant District Attorney Middlesex District Attorney’s Office 15 Commonwealth Avenue Woburn, MA 01801 Dear Attorney DeBlander: I have received the petition of Patrick O’Donnell appealing the response of the Middlesex District Attorney’s Office (Office) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 28, 2023, Mr. O’Donnell requested records related to a specific incident that occurred at approximately 1:00 am on Massachusetts Avenue in Cambridge on March 25, 2023. The Office provided a response on April 12, 2023. Unsatisfied with the Office’s response, Mr. O’Donnell petitioned this office and SPR23/1117, was opened as a result. Based upon a conversation between a representative of the Office and a staff attorney of the Public Records Division, it is my understanding that the Office intends on providing a further response to Mr. O’Donnell to address his records request. Accordingly, the Office is ordered to provide Mr. O’Donnell with said response in a manner consistent with the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. O’Donnell may appeal the substantive nature of the Office’s response within ninety days. See 950 C.M.R. 32.08(1).
