Tyree appealing the nonresponse of the Department of Correction (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 23, 2023, Mr. Tyree requested the following records: (1.) Copies of the MDOC Commissary Master List (as of this date) previously referred to as RFR #13 DOC Commissary Vendor Response Sheet; (2.) Copies of any, and all Rules, DOC Policies, Regulations, Directives, applicable to Souza-Baranowski Correctional Center, (SBCC), that detail how many items must be made available on the SBCC Inmate Canteen Kiosk; (3.) A copy of all canteen stock, (i.e., food, cosmetics-stationary, pens, shampoo, etc) that was available to be purchased from the SBCC Inmate Canteen Kiosk on Thursday, December 1, 2022; (4.) A copy of all canteen stock, (i.e., food, cosmetics-stationary, pens, shampoo, etc) that was available to be purchased from the SBCC Inmate Canteen Kiosk on Thursday, April 13, 2023; (5.) A copy of any, and all records that reflects who decides what products are sold to the inmate population at SBCC: is it the Vendor (Keefe Canteen), or the DOC/SBCC; and what guidelines (if any exist), on what products are sold, and which products are not sold. Claiming to not yet have received responsive records, Mr. Tyree petitioned this office and this appeal, SPR23/1138, was opened as a result. Subsequently, I learned that the Department provided Mr. Tyree with a response dated June 5, 2023. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed.
