Tyree appealing the nonresponse of the Department of Correction (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 24, 2023, Mr. Tyree requested the following records: (1.) Copies of any, and all records that will reflect: (A.) the number of movies that should be on the SBCC Inmate Canteen Kiosk (SBCC ICK) for rent to the inmates at SBCC;2/ (B.) how often must new movies to rent, show up/be placed on the SBCC ICK (i.e., is it every 30 days, 60 days, 90 days, 120 days, etc);3/ (C.) [a]re new movies required to be placed on the SBCC ICK for rent, or can they be a rehashed collection of reruns of reruns of reruns;4/ (D.) does the contract with Keefe Canteen for movies, include television programs that may be placed on the SBCC ICK to rent;5/ (E.) does the SBCC/DOC staff have any input as to which Rated G/PG/PG13 movies are put on the SBCC ICK. Claiming to not yet have received responsive records, Mr. Tyree petitioned this office and this appeal, SPR23/1139, was opened as a result. Subsequently, I learned that the Department provided Mr. Tyree with a response dated June 5, 2023. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Mr. Tyree may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
