Contos appealing the nonresponse of the National Guard (Guard) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 18, 2023, Mr. Contos requested the following: [1.] The address for the current unit or organization that is responsible for base security at Joint Base Cape Cod, the Camp Edwards Range Area, and the Otis A.N.G.B. To include the name of the person in charge and a current phone number [;] [2.] The address for the Mass Military Reservation Security (MMR Security) section at Camp Edwards. To include the person in charge and or the name of their records access officer. [Or] …the address and point of contact of who would have these records [;] [3.] The address of the U.S. Army Munitions Storage Area at Camp Edwards called ‘Goat Hill,’ located in the training/range area. To include the person in charge, a current phone number and or the name of their records access officer. Claiming to not yet have received responsive records, Mr. Contos petitioned this office and this appeal, SPR23/1141, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Guard has provided a response. Accordingly, the Guard is ordered to provide Mr. Contos with a response to the request, provided in a manner consistent with this order, the Public Records Law, and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us.
