The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records June 7, 2023 SPR23/1170 Kate Silvia Director of Communications Massachusetts Department of Correction 50 Maple Street Milford, MA 01757 Dear Ms. Silvia: I have received the petition of Joshua Carrier appealing the nonresponse of the Department of Correction (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 18, 2023, Mr. Carrier requested the following records: [1] Old Colony Correctional Center program application packet that was submitted and approved in 2022-2023 for the OCCC music program and/or music theory program [;] [2] Any Old Colony Correctional center program application that was submitted prior to the approved current packet for the music program [;] [3] Any and all documents that has been obtained by the agency talking about OCCC music program in 2022-2023 by parties including but not limited to [named persons], etc. Claiming to not yet have received responsive records, Mr. Carrier petitioned this office and this appeal, SPR23/1170, was opened as a result. Subsequently, I learned that the Department provided Mr. Carrier with a response dated June 2, 2023. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Mr. Carrier may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
