See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 17, 2023, Mr. Guzman requested “[a]ll quarterly reports submitted to the Lawrence School Committee pursuant to G. L. c. 69, §1K(g) regarding the work on the turnaround plan 2018/2019 through 2021/2022.” On May 4, 2023, the Department’s Deputy Commissioner, Russell Johnston, PhD, provided Mr. Guzman with a response indicating, “[c]urrently, we are working to identify the records that respond to your request. Once the records are compiled, we will review and prepare them for production. Department staff will produce the requested records as soon as possible.” On May 5, 2023, the Department provided a written response to Mr. Guzman’s request. As a result of the Department’s May 5th response, Mr. Guzman petitioned the Supervisor of Records (Supervisor), and this appeal was opened. Subsequent to the opening of this appeal, the Department provided a supplemental response to Mr. Guzman on June 13, 2023. Conclusion Accordingly, where this appeal was opened as a result of the Department’s May 5, 2023 response, I will now consider this administrative appeal closed. Mr. Guzman may appeal the substantive nature of the Department’s June 13th response within 90 calendar days. See 950 C.M.R. 32.08(1).
