Assistant General Counsel Executive Office of Public Safety and Security 1 Ashburton Place, Room 2133 Boston, MA 02108 Dear Attorney Mullaney: I have received the petition of Christopher Burrell, of WGBH 89.7 Public Radio, appealing the nonresponse of the Executive Office of Public Safety and Security (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 18, 2023, Mr. Burrell requested the following records: [1] A copy of the current contract with APDS for tablets[;] [2] Records that describe education/training policies for recently‐purchased tablets[;] [3] Records showing which educational programs in DOC facilities currently have in-person instruction happening in classrooms[;] [4] Records showing policy about which educational content will be offered ONLY on tablets and educational programming that will still be taught in live classroom setting. Claiming to not yet have received responsive records, Mr. Burrell petitioned this office and this appeal, SPR23/1228, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Office has provided a response. Accordingly, the Office is ordered to provide Mr. Burrell with a response to the request, provided in a manner consistent with this order, the Public Records Law, and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Burrell may appeal the substantive nature of the Office’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
