Assistant District Attorney Appeals Division Essex County District Attorney’s Office Ten Federal Street Salem, MA 01970 Dear Attorney Johnson: I have received the petition of Jeff Raymond appealing the nonresponse of the Essex County District Attorney’s Office (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 11, 2023, Mr. Raymond requested the following documents: [1.] A copy of any communications sent from the EDA between the dates of July 1, 2021 and May 11, 2023 regarding compliance with The Massachusetts Peace Officer Standards and Training (POST) Commission and their “database listing complaints against police officers” planned for May 2022, including any back- and-forth exchanges that may have occurred in response to those communications, broadly construed. [2.] A list of all public records requests to the EDA in 2023. [3.] The text of and responses for any public records requests to the EDA concerning the abovementioned POST Commission between July 1, 2021 and May 11, 2023, including but not limited to the responsive documents provided to the petitioner. [4.] A copy of any communications received from or sent to external, non-EDA organizations (including but not limited to organizations such as sheriff’s departments, department of corrections, University of Massachusetts entities, local police departments, etc.) EDA [sic] between the dates of July 1, 2021 and May 11, 2023 with the subject matter concerning responses to public records requests, broadly construed. Johnson, Esq SPR23/1273 Page 2 June 23, 2023 Claiming to not yet have received a response, Mr. Raymond petitioned this office and this appeal, SPR23/1273, was opened as a result. Subsequently, I learned that the Office provided a response to Mr. Raymond on June 11, 2023. Where this appeal was opened as a result of the Office’s lack of a written response, I will now consider this administrative appeal closed.
