Muldoon appealing the nonresponse of the Department of Correction (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 15, 2023, Mr. Muldoon requested the following records: 1. A copy of 103 DOC 153 2. A copy of 103 DOC 206 3. A copy of 103 DOC 158 4. The identify [sic] of the Record Liaison Officer for MCI Norfolk.... 5. A copy of the Statewide Records Retention Schedule.... 6. The identity of the staff member that assists with the storage and destruction of documents.... Claiming to not yet have received responsive records, Mr. Muldoon petitioned this office and this appeal, SPR23/1277, was opened as a result. Subsequently, I learned that the Department provided Mr. Muldoon with a response dated June 5, 2023. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Mr. Muldoon may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
