Morse, of the Law Offices of James T. Morse, LLC., appealing the nonresponse of the Falmouth Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 9, 2023, Attorney Morse requested the following records: [1] Copies of any general orders, special orders, standard operating procedures, rules or regulations of the Falmouth Police Department that were in existence in or on October of 2022 concerning the following topics or areas: arrests, OUI investigations, transport, booking or release of prisoners, medical emergencies, transportation of persons under arrest to hospital, guarding of prisoners, supervision of personnel/supervisors[;] [2] Copies of any internal complaints, disciplinary reports, disciplinary decisions (including appeals under civil service or collective bargaining agreement) memorandums, letters, correspondence or notations or records of counseling, retraining, verbal reprimands or other informal corrective action or discipline for the following employees of the Department. . .[.] Claiming to not yet have received responsive records, Attorney Morse petitioned this office and this appeal, SPR23/1293, was opened as a result. Subsequently, I learned that the Department provided a response to Attorney Morse on June 23, 2023. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Attorney Morse may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
