The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records June 28, 2023 SPR23/1296 Timothy Sherblom Chief of Police Holden Police Department 1370 Main Street Holden, MA 01520 Dear Chief Sherblom: I have received the petition of Denise Lindberg appealing the nonresponse of the Holden Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 25, 2023, Ms. Lindberg requested the following five (5) categories of records related to the Holden Animal Control Officer: 1. All records relating to any complaint brought against a Holden Animal Control Officer from 2018 to the present. 2. A copy of the job description for the Holden Animal Control Officer. 3. All information pertaining to the duties of the Animal Control officer dealing with wild animal issues. 4. The name/hours and salary for the current Holden Animal Control Officers. 5. Any rule/law/regulation restricting the Animal Control Officer from accessing private property with the homeowner’s consent. Claiming to not yet have received responsive records, Ms. Lindberg petitioned this office and this appeal, SPR23/1296, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Department has provided a response. Accordingly, the Department is ordered to provide Ms. Lindberg with a response to her request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. Lindberg may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
