The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records June 28, 2023 SPR23/1315 Dr. Allison LeClair Superintendent of Schools Easthampton Public Schools 50 Payson Avenue Easthampton, MA 01027 Dear Dr. LeClair: I have received the petition of Shelby Lee appealing the response of the Easthampton Public Schools (School) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 26, 2023, Ms. Gomez requested: 1. Any and all policies regarding Easthampton Public Schools student unenrollment processes and procedures from August 1, 2021 to May 1, 2023. 2. Any and all documents and communications - including but not limited to emails and text messages- regarding student unenrollment by staff members of Center-Pepin from September 1, 2021 to September 31, 2021. 3. Any and all documents and communications - including but not limited to emails and text messages- regarding student unenrollment by Allison Leclair from September 1, 2021 to September 31, 2021[.] On June 5, 2023, the School responded and indicated that it was withholding responsive records pursuant to Exemption (c) of the Public Records Law. Unsatisfied with the School’s response, Ms. Lee petitioned this office and this appeal, SPR23/1315, was opened as a result. Subsequently, I learned that the School intends on providing a further response to Ms. Lee. Accordingly, the School is ordered to provide Ms. Lee with a response in accordance with the Public Records Law, its Regulations and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. Lee may appeal the substantive nature of the School’s response within ninety days. See 950 C.M.R. 32.08(1).
