Assistant District Attorney Office of the Bristol County District Attorney 218 South Main Street, Suite 101 Fall River, MA 02720 Dear Attorney Lee: I have received the petition of Daniel Jaffe, of the Committee for Public Counsel Services, appealing the response of the Office of the Bristol County District Attorney (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 4, 2023, Mr. Jaffee requested: [1] All rules, policies, procedures, memoranda, or guidance pertaining to the DAMION database, including but not limiting to, data input and entry; and, [2] All employee training materials, user guides and agreements, PowerPoint slides, handouts, and audits related to the DAMION database, including but not limited to, data input and entry. On May 18, 2023, the Office responded, “[y]our request is denied.” As a result, Mr. Jaffee petitioned the Supervisor of Records (Supervisor), and this appeal was opened. Subsequent to the opening of this appeal, on July 5, 2023, the Office provided Mr. Jaffe with a supplemental response. Conclusion Accordingly, whereas this appeal was opened due to the Office’s May 18, 2023 response, I will consider this administrative appeal closed. Mr. Jaffe may appeal the substantive nature of the Office’s July 5th response within 90 calendar days. See 950 C.M.R. 32.08(1).
