General Counsel Department of Criminal Justice Information Services 200 Arlington Street, Suite 2200 Chelsea, MA 02150 Dear Attorney Koulouris: I have received the petition of Murat Erkan, Esq., of Erkan & Associates, LLC, appealing the nonresponse of the Department of Criminal Justice Information Services (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 5, 2023, Attorney Erkan requested the following records: [1.] From 1996 to present, all versions of the form(s) or document(s) representing the ‘prescribed manner’ in which licensing authorities, as defined by G.L. c. 140 s. 121, must notify DCJIS (or predecessor entities) of the granting or renewal of a license to possess or carry a firearm, pursuant to G.L. c. 140, s. 122A[;] [2.] From 1996 to present, all versions of the rules and regulations promulgated pursuant to G.L. c. 140, s. 122A[;] [3.] [R]ecords of any audits, studies, internal memoranda or reports relating to the compliance of licensing authorities with the requirements of G.L. c. 140, s. 122A[;] [4.] [A]ny internal guidelines or other documents reflecting the procedure by which DCJIS (or predecessor entities) create or store records submitted pursuant to G.L. c. 140, s. 122A. Claiming to not yet have received responsive records, Attorney Erkan petitioned this office and this appeal, SPR23/1374, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Department has provided a response. Accordingly, the Department is ordered to provide Attorney Erkan with a response to his request, provided in a manner consistent with this order, the Public Records Law, and its Regulations within ten (10) business days. A copy of any such response must be provided to this office.
