The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records July 13, 2023 SPR23/1507 Helen Rush-Lloyd Records Access Officer Department of Public Health 250 Washington Street Boston, MA 02108 Dear Ms. Rush-Lloyd: I have received the petition of Emmett Muldoon appealing the nonresponse of the Department of Public Health (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 8, 2023, Mr. Muldoon requested the following records: [1]. A summary of the recent COVID-19 outbreak at the Chelsea Veterans’ Home. This summary should include the number of individuals infected by COVID (regardless of whether they were patients, staff, or visitors). [2.] A listing of institutions (hospitals, public-private institutions (prisons, mental health facilities, ect.) in which COVID has infected at least one individual). [3.] Any memorandum(s) which predict (to a reasonable degree of medical certainty) the impact of COVID through the end of 2023 or beyond. Claiming to not yet have received responsive records, Mr. Muldoon petitioned this office and this appeal, SPR23/1507, was opened as a result. Subsequently, I learned that the Department provided Mr. Muldoon with a response dated June 26, 2023. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Mr. Muldoon may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
