Records Access Officer Berkshire District Attorney’s Office 7 North Street Pittsfield, MA 01201 Dear Attorney Pieropan: I have received the petition of Jason Sefton appealing the nonresponse of the Berkshire District Attorney’s Office (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 31, 2023, Mr. Sefton requested records related to “an incident that happened in the city of Pittsfield, dated October 15, 2018 resulting in the death of [a named individual].” Claiming to not yet have received responsive records, Mr. Sefton petitioned this office and this appeal, SPR23/1531, was opened as a result. Subsequently, I learned that the Office provided Mr. Sefton with a response dated July 5, 2023. Where this appeal was opened as a result of the Office’s lack of a written response, I will consider this administrative appeal closed. Mr. Sefton may appeal the substantive nature of the Office’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
