The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records July 18, 2023 SPR23/1540 Shawn A. Williams, Esq. Director of Public Records Records Access Officer City of Boston One City Hall Square Boston, MA 02201 Dear Attorney Williams: I have received the petition of the Boston Accountability Network, appealing the nonresponse of the City of Boston (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 14, 2023, the requestor sought the following records: [1.] ... copies of public records that pertain to all evidence (traffic camera footage, body camera footage, audio recordings, written and printed documentation, etc.) related to the alleged traffic stop of [two named individuals] that is alleged to have occurred in December 2022. The alleged incident is reported to have taken place in the B-3 District but should not be considered limited to this location. [2.] ... all records (traffic camera footage, body camera footage, audio recordings, written and printed documentation, etc.) pertaining to Boston Police Department employees that were placed on administrative leave in December 2022 as well as all material related to that administrative leave. Claiming to not yet have received responsive records, the requestor petitioned this office and this appeal, SPR23/1540, was opened as a result. Subsequently, I learned that the City provided the requestor with a response dated July 12, 2023. Where this appeal was opened as a result of the City’s lack of a written response, I will now consider this administrative appeal closed. The requestor may appeal the substantive nature of the City’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
