Hennessey, Esq. appealing the nonresponse of the City of Worcester (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 6, 2023, Attorney Hennessey requested the following records: [1.] All accident reports and investigation reports of an accident occurring on June 10, 2021 in the area of [a named location] [2.] All investigation reports and internal affairs reports, accident reconstruction reports and interviews involving the accident with a Worcester Police cruiser on June 10, 2021 in the area of [a named location] [3.] Copies of all videos and photographs taken by the Worcester Police and/or obtained by the Worcester Police in the course of their investigation of a motor vehicle vs. pedestrian accident in the area of [a named location] on June 10, 2021 involving a Worcester Police cruiser and/or a Worcester Police Officer. Claiming to not yet have received responsive records, Attorney Hennessey petitioned this office and this appeal, SPR23/1557, was opened as a result. Subsequently, I learned that the City provided Attorney Hennessey with a response dated July 18, 2023. Where this appeal was opened as a result of the City’s lack of a written response, I will now consider this administrative appeal closed. Attorney Hennessey may appeal the substantive nature of the City’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
