Muldoon appealing the nonresponse of the Permanent Commission on the Status of Persons with Disabilities (Commission) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 8, 2023, Mr. Muldoon requested the following records: [1.] A copy of the Commission’s annual report[;] [2.] A listing of all members of the Commission…[;] [3.] For the past fiscal year, a copy of all draft legislation, as included at G. L. c. 3, § 74(g)[;] [4.] A copy of each assessment of programs and practices of all state agencies, as included at G. L. c. 3, § 74(f)(iii)[;] [5.] A copy of all advisements to executive and legislative bodies regarding the impact of proposed legislation on persons with disabilities[;] [6.] A copy of the uniform and accessible application, identified at G. L. c. 3, § 74(d)(3)[.] Claiming to not yet have received responsive records, Mr. Muldoon petitioned this office and this appeal, SPR23/1565, was opened as a result. Subsequently, I learned that the Commission provided a response to Mr. Muldoon on July 13, 2023. Where this appeal was opened as a result of the Commission’s lack of a written response, I will now consider this administrative appeal closed. Mr. Muldoon may appeal the substantive nature of the Commission’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
