Records Access Officer Suffolk County District Attorney’s Office One Bulfinch Place Boston, MA 02114 Dear Attorney Doherty: I have received the petition of Susan L. Bach appealing the response of the Suffolk County District Attorney’s Office (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 7, 2023, Ms. Bach requested records related to a specific review conducted by the Office, “including findings and the identity of the reviewers.” This request was the subject of a previous appeal. See SPR23/0740 Determination of the Supervisor of Records (April 27, 2023). In my April 27th determination, I ordered the Office to clarify whether it possesses additional records responsive to Ms. Bach’s request. Subsequently, the Office responded on May 31, 2023 and June 16, 2023, providing numerous records in redacted form. Unsatisfied with the Office’s response, Ms. Bach appealed, and this case was opened as a result. Based on a telephone conversation between this office and the Office on July 20, 2023, I understand that the Office intends to provide a supplemental response to Ms. Bach. Accordingly, said response must be provided in a manner consistent with the Public Records Law and its regulations within ten business days. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. If issues remain unresolved, Ms. Bach may appeal the substantive nature of the Office’s supplemental response within ninety days. See 950 C.M.R. 32.08(1).
