Chubb Records Access Officer Duxbury Police Department 155 Mayflower Street Duxbury, MA 02332 Dear Lieutenant Chubb: I have received the petition of Owen P. McGowan, Esq. appealing the nonresponse of the Duxbury Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 27, 2023, Attorney McGowan requested: [A]ny and all records, of any kind whatsoever, including, but not limited to, text messages, police logs, ... calendars, accident reports, photographs, police reports, press releases, emails, documentation of any kind whatsoever pertaining to any interaction by any person whomever with any member of the Duxbury Police Department as it pertains to the accident between [named individuals] dated May 15, 2014. Claiming to not yet have received responsive records, Attorney McGowan petitioned this office and this appeal, SPR23/1634, was opened as a result. Subsequently, I learned that the Department provided Attorney McGowan with a response dated July 17, 2023. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed.
