Office of the General Counsel Division of Capital Asset Management & Maintenance One Ashburton Place, 15th Floor Boston, MA 02108 Dear Attorney Guerin: I have received the petition of Mallory Hanora appealing the response of the Division of Capital Asset Management & Maintenance (Division) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 19, 2023, Ms. Hanora requested “meeting notes from bi-weekly meetings between HDR, DOC, and DCAMM from January 1 2023 - present” for the project named “Study and Design of Correctional Center for Women.” The Division responded on May 24, 2023, providing responsive records and citing Exemptions (d) and (n) of the Public Records Law for redacting the records. See G. L. c. 4, § 7(26)(d), (n). Unsatisfied with the Division’s response, Ms. Hanora appealed, and this case was opened as a result. Subsequent to the opening of this appeal, based on telephone conversations between this office and an attorney for the Division on July 25, and July 27, 2023, I understand that the Division intends to provide a supplemental response to Ms. Hanora. Accordingly, said response must be provided in a manner consistent with the Public Records Law and its regulations within ten business days. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. If issues remain unresolved, Ms. Hanora may appeal the substantive nature of the Division’s supplemental response within ninety days. See 950 C.M.R. 32.08(1).
