First Associate City Solicitor City of Springfield Law Department 36 Court Street Springfield, MA 01103 Dear Attorney Saint Laurent: I have received the petition of Jessica Lewis, Esq., of the American Civil Liberties Union of Massachusetts, appealing the responses of the City of Springfield (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 3, 2023, Attorney Lewis requested: [1] Document written by [a named individual] dated October 2, 2020. This document is sometimes, but not exclusively, referred to as the “Kent report” or the “Kent memo.” For ease of reference, I have attached as Exhibit A an affidavit of [a named individual], which describes the document. [2] Records, including email communications, showing receipt and/or transmission of the document referenced in request number 1 above. [3] Records, including email communications, referencing and/or discussing the document referenced in request number 1 above. [4] Records, including agendas, calendar invitations, and meeting notes, of the meeting with [two named individuals], and “members of the SPD leadership team” referenced in paragraph no. 3 of Exhibit A. [5] The 28-page report entitled “Rebuttal to the Department of Justice Investigation of the Springfield, Massachusetts, Narcotics Bureau” referenced in [an identified article]. On April 18 and June 14, 2023, the City responded. Unsatisfied with the City’s responses, Attorney Lewis petitioned this office and this appeal, SPR23/1655, was opened as a result. Where this appeal was opened as a result of the City’s April 18th and June 14th responses, I will now consider this administrative appeal closed. Attorney Lewis may appeal the substantive nature of the City’s July 31st response within ninety (90) days. See 950 C.M.R. 32.08(1).
