The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records August 1, 2023 SPR23/1677 Jonah Temple Deputy City Solicitor City of Newton, Law Department 1000 Commonwealth Avenue Newton, MA 02459 Dear Attorney Temple: I have received the petition of John Hilliard appealing the nonresponse of the Newton Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 28, 2023, Mr. Hilliard requested the following: [1.] Any requests for police service at . . . Washington St., from Jan. 1, 2020, to present[;] [2.] Any reports, recordings of emergency calls or transmissions related to requests for service at . . . Washington St. during that period[;] [3.] Any requests for police service at . . . Curve St., from Jan. 1, 2020, to present[;] [4.] Any reports, recordings of emergency calls or transmissions related to requests for service at . . . Curve St. during that period. Claiming to not yet have received responsive records, Mr. Hilliard petitioned this office and this appeal, SPR23/1677, was opened as a result. Subsequently, I learned that the Department provided Mr. Hilliard with a response dated July 28, 2023. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Mr. Hilliard may appeal the substantive nature of the Department’s July 28th response within ninety (90) days. See 950 C.M.R. 32.08(1).
