The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records August 4, 2023 SPR23/1701 Thomas Mastuszko Records Custodian Berkshire Regional Planning Commission 1 Fenn Street, Suite 201 Pittsfield, MA 01201 Dear Mr. Mastuszko, I have received the petition of Joshua Bloom appealing the nonresponse of the Berkshire Regional Planning Commission (Commission) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 1, 2023, Mr. Bloom requested “[a]ll your communications with Counsel regarding your efforts to seek ‘legal advice to determine how to handle []’ my request.” Claiming to not yet have received responsive records, Mr. Bloom petitioned this office and this appeal, SPR23/1701, was opened as a result. Subsequently, a representative of the Commission provided a response on July 26, 2023 to Mr. Bloom’s request. Where this appeal was opened as a result of the Commission’s lack of a written response, I will now consider this administrative appeal closed. Mr. Bloom may appeal the substantive nature of the Commission July 26th response within 90 days. See 950 C.M.R. 32.08(1).
