LeLacheur Beverly Police Department 175 Elliott Street Beverly, MA 01915 Dear Chief LeLacheur: I have received the petition of Andrew Quemere appealing the nonresponse of the Beverly Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 12, 2023, Mr. Quemere requested the following records: [1.] All documents related to the destruction of internal affairs records for [named individual], including but not necessarily limited to requests to destroy records and approval to destroy records[;] [2.] All retention schedules and other policy documents related to the maintenance and destruction of internal affairs records[.] Claiming to not yet have received responsive records, Mr. Quemere petitioned this office and this appeal, SPR23/1711, was opened as a result. Subsequently, I learned that the Department provided a response to Mr. Quemere on July 26, 2023. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Mr. Quemere may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
