Newton Police Department Information Technology Bureau 1321 Washington Street Newton, MA 02465 Dear Attorney Temple: I have received the petition of Frank Wood appealing the nonresponse of the Newton Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 27, 2023, Mr. Wood requested “…all police reports/arrest reports where [an identified individual] was a victim or suspect between February 2023 and present, excluding the report on the current murder.” Claiming to not yet have received responsive records, Mr. Wood petitioned this office and this appeal, SPR23/1716, was opened as a result. Subsequently, I learned that the Department provided Mr. Wood with a response dated July 28, 2023. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Mr. Wood may appeal the substantive nature of the Department’s July 28th response within ninety (90) days. See 950 C.M.R. 32.09(1).
