The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records August 3, 2023 SPR23/1729 Shirley Dorai Executive Assistant to the Superintendent Malden Public Schools 110 Pleasant Street Malden, MA 02148 Dear Ms. Dorai: On August 3, 2023, this office received your petition on behalf of the Malden Public Schools (School) seeking an extension of time to produce records, and permission to charge for time spent segregating or redacting responsive records. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv); see also 950 C.M.R. 32.06(4). As required by law, the School furnished a copy of this petition to the requestor. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv)(2). On July 13, 2023, Malden News Network requested the following: [A]ny records created, sent or received, from 1/1/23 to the date of your response to this request, by any staff member in the Malden Public School System related to the hiring of any Assistant Principal or Principal into the Malden School System during the calendar year 2023. This should include the following types of records: • Job Descriptions, including required certifications, qualifications, school descriptions etc. • Emails (with attachments) exchanged in relation to any open position, including recommendations / references /referrals / requirements by any City of Malden personnel • Calendar entries for any and all meetings between staff and any candidate eventually interviewed for either position in any school • Offer letters, in their final form, extended to candidates offered positions, whether or not they accepted[.] In an email to this office on July 27, 2023, Malden News Network states that it “has no current interest in obtaining public records as described in the FEE PETITION” and further states that it “formally withdraws records requests where Malden wishes to incur further costs and a FEE PETITION.” One Ashburton Place, Room 1719, Boston, Massachusetts 02108 • (617) 727-2832 • Fax: (617) 727-5914 sec.state.ma.us/pre • pre@sec.state.ma.us Shirley Dorai SPR23/1729 Page 2 August 3, 2023 Conclusion In light of Malden News Network’s July 27th email, it is unnecessary to opine on the School’s petition for an extension of time to produce records and permission to charge for time spent segregating or redacting responsive records.
