Gaitan Primary Records Access Officer Massachusetts National Guard 2 Randolph Road Hanscom Air Force Base, MA 01731 Dear Mr. Gaitan: I have received the petition of Don Keeran, of the Association to Preserve Cape Cod, appealing the nonresponse of the Massachusetts National Guard (Guard) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 19, 2023, Mr. Keeran requested “the email between [identified individuals] dated July 10, 2020, cited in [an identified document] dated June 26, 2023, submitted under cover of a letter dated June 25, 2023 from [an identified individual] to [another identified individual].” Claiming to not yet have received a response, Mr. Keeran petitioned this office and this appeal, SPR23/1797, was opened as a result. It is my understanding that the Guard did not receive the records request until the appeal acknowledgement was sent out on August 3, 2023. Subsequently, I learned that the Guard intends on providing a written response to Mr. Keeran. Accordingly, the Guard is ordered to provide Mr. Keeran with a response in accordance with the Public Records Law, its Regulations and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Keeran may appeal the substantive nature of the Guard’s response within ninety days. See 950 C.M.R. 32.08(1).
