Tyree appealing the nonresponse of the Department of Correction (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 20, 2023, Mr. Tyree requested the following records: [1.] [A]ll records that relate to the MCI-Walpole, (a.k.a. MCI-Cedar Junction) and MCI-Norfolk, Inmate Benefit Fund, (IBF), … as defined and seen in 103 DOC 476, which is maintained by the Dept. of Correction, (DOC), Audit [a]nd Compliance Unit, for the year of 2006. [2]. [T]he Inmate Benefit Revenue Report (IBRR), from MCI-Walpole/Cedar Junction, and MCI-Norfolk, for the year of 2006. Claiming to not yet have received a response, Mr. Tyree petitioned this office and this appeal, SPR23/1803, was opened as a result. Subsequently, I learned the Department provided a response to Mr. Tyree on August 10, 2023. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Mr. Tyree may appeal the substantive nature of the Department’s response within 90 days. See 950 C.M.R. 32.08(1).
