Assistant General Counsel Records Access Officer Massachusetts Bay Transportation Authority 10 Park Plaza, Suite 3910 Boston, MA 02116 Dear Attorney Ciollo: I have received the petition of Andrea Estes appealing the response of the Massachusetts Bay Transportation Authority (MBTA) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 3, 2023, Ms. Estes requested, “[l]og of phone calls and texts made to or from the following [identified] number ... between April 18 and April 24, 2023.” The MBTA responded on July 17, 2023. Unsatisfied with the MBTA’s response, Ms. Estes petitioned this office and this appeal, SPR23/1808, was opened as a result. Subsequently, I learned that the MBTA provided a further response to Ms. Estes on August 15, 2023. Where this appeal was opened as a result of the MBTA’s July 17th response, I will now consider this administrative appeal closed. Ms. Estes may appeal the substantive nature of the MBTA’s August 15th response within ninety (90) days. See 950 C.M.R. 32.08(1).
