The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records August 16, 2023 SPR23/1814 Alexandra Hayden Records Access Officer Chelmsford Police Department 2 Olde North Road Chelmsford, MA 01824 Dear Ms. Hayden: I have received the petition of Corey Kelleher appealing the response of the Chelmsford Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 20, 2023, Mr. Kelleher requested “another copy of what I requested and received. The police report and both calls into the police.” Previous Petition This request was the subject of a previous fee petition. See SPR23/1431 Determination of the Supervisor of Records (June 28, 2023). In my June 28th determination, I found that to the extent the responsive records contain exempt information described in the Department’s fee petition, the Department may assess a fee for the segregation and redaction of such exempt material. On June 28, 2023, the Department responded to Mr. Kelleher with a fee estimate of $25.00. Unsatisfied with the Department’s response, Mr. Kelleher petitioned this office and this appeal, SPR23/1814, was opened as a result. Subsequently, I learned that the Department provided a further response dated August 7, 2023, to Mr. Kelleher. Where this appeal was opened as a result of the Department’s June 28th response, I will now consider this administrative appeal closed. Mr. Kelleher may appeal the substantive nature of the Department’s August 7th response within ninety (90) days. See 950 C.M.R. 32.08(1).
