See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 24, 2023, Attorney O’Donnell requested “... copies of the police report as well as any and all photographs taken of the scene [of an identified incident].” Claiming to not yet have received responsive records, Attorney O’Donnell petitioned this office and this appeal, SPR23/1840, was opened as a result. Subsequently, I learned that the Department provided Attorney O’Donnell with a response dated August 7, 2023. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Attorney O’Donnell may appeal the substantive nature of the Department’s August 7th response within ninety (90) days. See 950 C.M.R. 32.08(1).
