The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records August 21, 2023 SPR23/1859 Diane Pelland, Town Clerk Town of Swansea 81 Main Street Swansea, MA 02777 Dear Ms. Pelland: I have received the petition of Geraldine Mullaly appealing the nonresponse of the Town of Swansea (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 27, 2023, Ms. Mullaly requested the following documents/exhibits for the Board of Selectmen Meeting dated 6/13/2023: Tax Increment Financing Agreement Isabellenhuteer[;] Memorandum - Municipal Complex services T2 Architects[;] Request for Departmental Transfer - Municipal Complex Design Services[;] Memo - CHA update Town Hall COA/Highway Garages[;] Minutes - Executive Session May 9, 2023[.] Claiming to not yet have received responsive records, Ms. Mullaly petitioned this office and this appeal, SPR23/1859, was opened as a result. Subsequently, I learned that the Town provided Ms. Mullaly with a response dated August 14, 2023. Where this appeal was opened as a result of the Town’s lack of a written response, I will now consider this administrative appeal closed. Ms. Mullaly may appeal the substantive nature of the Town’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
