The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records August 24, 2023 SPR23/1867 Officer John Pyers Records Access Officer Lowell Police Department 50 Arcand Drive Lowell, MA 01852 Dear Officer Pyers: I have received the petition of Amy Codagnone, Esq., appealing the nonresponse of the Lowell Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 26, 2023, Attorney Codagnone requested: [1.] Any and all records including witness statements given in connection with any investigation of criminal activity of [an identified individual]; [2.] Any and all records containing references to [an identified individual]; [3.] Any and all correspondence to, from, or referencing [an identified individual]; [4.] Any and all reports or records pertaining to investigations or interviews prior to, during, or after the investigation of the death of [an identified individual]. Claiming to not yet have received responsive records, Attorney Codagnone petitioned this office and this appeal, SPR23/1867, was opened as a result. Despite being notified of the opening of this appeal, it is unclear whether a response has been provided. Accordingly, the Department is ordered to provide Attorney Codagnone with a response to the request, provided in a manner consistent with this order, the Public Records Law, and its Regulations within 10 business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us.
